Construction Claims Premium E-Course

C3M6V1 Responses and Determinations

Every claim requires a response or determination of some sort. This module deals with the effective drafting and presentation of responses so as to close out issues in a timely manner and prevent disputes.

The assignments place you in the position of the Engineer and require you to prepare responses to three claims. The claims are of different quality and content and the assignments require the engineer to respond to them from different strategic points of view.

C3M5V1 Delay Analysis and Entitlement

Construction Claims Premium E-Course

C3M5V1 Delay Analysis and Entitlement

This is another two-part module which deals with the separate subjects of delay analysis and the contractual entitlement to make a claim.

An extension of time claim will fail unless it demonstrates that the delay had an effect on the completion date. This module provides an overview of delay analysis principles, including concurrent delay, float and the critical path, how to link cause and effect and how to show the effect of the delay on the time for completion. The assignments require you to prepare basic examples of an impacted-as-planned and a time-impact delay analysis to illustrate the principles discussed.

In order for a claim to succeed, the event that is the basis of the claim must be something for which the contract allows the claimant to seek compensation. It is therefore essential that a claim includes an examination of the contractual provisions and clearly includes justification as to why the event is admissible under the contract. Your assignments for this section of the module require you to produce claim narratives that demonstrate entitlement for two case studies.

C3M4V1 Cause and Effect

Construction Claims Premium E-Course

C3M4V1 Cause and Effect

In order for a claim to succeed, it is essential to establish the cause and its effect on the completion date or the contract price. After studying this subject and checking the examples included in the module document, this module requires you to examine four events included in a case study, establish the causes of delay and their effects upon the project, and to set out your findings in a ‘cause and effect’ section of a claim narrative.

C3M3V1 Strategy, Claims Management and Preliminaries to the Claim

Construction Claims Premium E-Course

C3M3V1 Strategy, Claims Management and Preliminaries to the Claim

This module is in two parts. The first part deals with claim strategies for managing claims from both the contractor and the engineer’s points of view. Your assignments place you in the positions of senior personnel within organisations and require you to look at two typical real-life scenarios and to formulate strategies for dealing with certain challenges related to claims that have occurred, or are likely to occur.

The second part of this module requires you to prepare the ‘front end’ of a claim document, otherwise known as the preliminaries to the claim. This will be your first exercise in hands-on claim preparation.
